WRITING TASK 2: You should spend 40 minutes on this task. Write about the following topic.
Question: Some people believe that there should be fixed punishments for each crime. Others, however, argue that the circumstances of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment.
Give reasons for your answer and include any relevant examples from your experience. You should write at least 250 words.
Answer of Cambridge Book 7 Test 2 Academic Writing Task 2
While some believe that a fixed-sentence system should be adopted, others argue that punishment should be based on motives and circumstances. Although fixing a punishment for a particular crime can make trials more efficient, I believe the motive should be considered to have a more just judgment process.
On the one hand, those who advocate implementing a judicial process of set punishments may argue that this would enhance the efficiency of criminal trials. A tremendous amount of time would be saved of courts when judges can refer to a particular crime and the law has a fixed punishment for that crime, so courts can work more efficiently and solve other pending cases. For example, in the UAE, once a jury has decided a particular defendant is guilty of murder, the judge only needs to refer to the ‘punishment for murder’ to sentence the person according to the pre-decided punishment without wasting the court’s precious time. However, I think this system is too rigid and should be more flexible.
On the other hand, adaptable punishments should be followed because they are fairer. Giving fixed sentences to those who did not want to commit the crime but were forced into doing it would not be justice. Therefore, more compassion is required towards offenders who have been blackmailed, threatened or manipulated into doing crimes. For example, if a person injured another person in self-defence, then it would not be justifiable to give them the same punishment as given to a person who did it intentionally. For this reason, I think that instead of enacting a fixed set of punishments, the sense of morality should be prioritised.
In conclusion, even though a legal system of fixed punishments might be more efficient, I believe that the procedure of assessing crimes based on circumstances and motives is more just, and justice is paramount.
